On 19 January 2021, the Court of Appeal in Warsaw, 3rd Labour and Social Insurance Division issued a judgment by virtue of which it dismissed the appeal of the Director of the Pension Fund of the Ministry of the Interior and Administration against the judgment of the Regional Court in Warsaw, granting the appellant, a former officer of the Ministry of the Interior, the right to a police pension in the amount prior to the entry into force of the Act reducing pensions received by members of the former communist Secret Service of December 2016. The Court of Appeal in Warsaw, like the Regional Court, shared the Law Firm’s position that the reduction of pension benefits for former officers of the Ministry of the Interior is contrary to the Constitution of the Republic of Poland and the norms of international law.
Thus, the appellant officer regained his pension in the amount prior to its reduction, carried out on the basis of the provisions of the aforesaid Act of December 2016. This is one of the first legally valid rulings restoring a pension for former officers of the Ministry of Internal Affairs.
The appealing officer was represented by attorney-at-law Jan Dudzik, attorney-at-law Joanna Zielińska and trainee attorney Dominika Krzysztofik.
