On 7 January 2021, the “Legalis” Legal Information Service published a publicly available article (so called n.ius) by attorney Aneta Fornalik on Business Law: “Covid regulation limiting the freedom to conduct business incompatible with the Constitution of the Republic of Poland.”
The publication is a selection of theses of the grounds for the judgment of the Provincial Administrative Court in Opole of 27 October 2020, ref. no.: II SA/Op 219/20 and a short commentary to the judgment.
The judgment is one of the first judgments concerning constitutionality of the so-called covid regulations. Recently, the grounds for the judgment of the Voivodship Administrative Court in Warsaw of 26 November 2020, file ref. no.: VIII SA/Wa491/20, which relates to the obligation to cover the mouth and nose, were also published.
