Acting for the J. Struś Municipal Hospital in Poznań, the Law Firm has successfully concluded a two-year breakthrough trial against the National Health Fund securing a PLN 1.4 million payment to the Hospital for the planned hospital treatment of patients in the year 2011. The trial strategy in this case had been prepared and implemented in the courtroom by counsel Anna Piotrowska-Musioł who challenged the system of accounting for the reported medical procedures applied in recent years by the NHF in all hospitals in Poland. Under this system, regardless of the duration of the stay, all procedures classified as “live-saving” are paid for first, which means that some of the previously reported and accounted for “planned patients” do not fall within the limit set by the NHF for a given year. Consequently, the cost of treatment of the patients who could not be included in the bill presented to the National Health Fund had to be financed by the Hospital and constituted the value of the claim.
