“Favourable ruling: relief regarding the repayment of a grant”

We are proud to announce another success for our Administrative Law Department in an exceptionally complex administrative case concerning the obligation to repay subsidies from the state budget.

Our client, a company in the transport sector, faced the necessity of immediately repaying nearly one million pln in unduly received subsidies for discounted bus tickets, together with interest. This amount posed a real threat to the company’s financial liquidity and its continued operation.

In this case, we prepared a comprehensive strategy aimed at protecting the client from potential administrative enforcement and challenging the validity of the decision determining the amount of the repayment. Our work included, amongst other things, a detailed legal analysis, representing the Client before public administration bodies and the administrative court, gathering financial and operational documentation, and working closely with specialists in the field of accounting and bookkeeping.

After several months of intensive work, we have seen the first results – we have secured a decision granting the Client relief from the repayment of the debt, consisting of:

1) the cancellation of all interest

2) the repayment of the principal amount in instalments over a period of several years

This outcome will allow the business to continue its long-standing operations, which employ over a dozen people and ensure transport links across several local authorities. The relief will also spare the client from having to sell assets and pay high contractual penalties.

We are also awaiting a ruling on the appeal lodged against the decision determining the amount of the subsidy to be repaid.
