On 25 August 2021, the Regional Court in Warsaw, 13th Labour and Social Insurance Division, issued a judgment under which it amended the appealed decision of the Director of the Internal Retirement Benefits Unit of the Ministry of the Interior and Administration and restored General Bogdan Libera’s right to a pension in the amount prior to 1 October 2017, which was reduced based on the so-called “repressive act”.
The Regional Court accepted the argument presented by barrister Jan Dudzik and unambiguously stated that the service of general Bogdan Libera in Department I of the Ministry of Internal Affairs (civilian intelligence service of the People’s Republic of Poland) did not have a character of “service for a totalitarian state”.
The decision of the Regional Court in Warsaw is yet another important ruling in the cases of appeals filed by our Law Firm against the decisions on redetermining the amount of retirement and disability benefits issued by the Director of the Internal Retirement Benefits Unit of the Ministry of the Interior and Administration.
Brigadier General Bogdan Libera in the years 1994-1996 and 1997-2001 served as Director of the Intelligence Board of the State Protection Office. In the years 2002 – 2005, he was an expert of parliamentary committees in the field of special services and protection of classified information.
