Conditional early release from serving the remainder of custodial sentence

On 6 April 2022, the Regional Court, 2nd Penitentiary and Supervision over the Execution of Penal Judgements Division heard the case of our Client based on the motion of the defence counsel to grant the convict, previously sentenced to a joint 2-year sentence, conditional early release from serving the remainder of the term of imprisonment, which expires in the first quarter of 2023. 

In the Court’s opinion, the motion of the defence counsel deserved to be granted, and the arguments raised in it proved to be correct. Despite the fact that the motion was not supported by the Deputy Director of the Penitentiary Institution, the Court shared the circumstances presented by the defence indicating that they determined that our Client fulfilled positive prerequisites of Article 77 § 1 of the Penal Code.

While issuing the decision on conditional early release, the Court decided to release the convict from the obligation to pay the remaining court costs.
