Legitimacy of claims for damages of purchasers of W Investments investment certificates against Alior Bank S.A. finally confirmed

The Court of Appeal dismissed the appeal filed by Alior Bank S.A. against the preliminary judgment of the Commercial Court, confirming the legitimacy of claims for compensation filed by the Law Firm on behalf of the purchaser of W Investments investment certificates against Alior Bank S.A.

We informed about the verdict of the Commercial Court, which recognised the Client’s claim for compensation of damage connected with the sale of the certificates by the Bank as legitimate in principle, on our website on 1 October 2020 and 14 December 2020.

The Bank appealed against the above ruling, submitting pleas regarding both the factual and legal basis of the ruling. The Court of Appeal shared the findings of fact made by the Commercial Court, as well as its legal assessment, dismissing the Bank’s appeal as unfounded.

As a result, the preliminary judgment of the Commercial Court, in which it recognised the Client’s claims for compensation of damages connected with the sale of FIZAN investment certificates by Alior Bank S.A. as justified in principle, is final and binding.
