In connection with the appearance in the media today, i.e. on 7 February 2022, of information on the ruling of the PAC in Warsaw in the case concerning the construction permit for the castle in Stobnica, we declare that:
1) On 12 January 2022, in the case of the construction permit, the Provincial Administrative Court in Warsaw, at a closed session, issued a judgment by virtue of which it reversed the decision of the Chief Building Inspector stating that the construction permit was invalid, and also reversed the decision of the Authority of First Instance.
The judgment is a consequence of allowing a complaint filed by our Law Firm on behalf of the investor.
The effect of the ruling is that construction works can continue.
The reasons for the decision are not known to the parties to the proceedings and we await the delivery of the reasoned decision.
The case is being handled on behalf of the investor by barrister Krzysztof Topolewski and barrister Aneta Fornalik.
2) In the criminal case, on the other hand, an indictment was filed on 29 December 2020. The case was referred to the Supreme Court to decide which court has jurisdiction to hear it. The counsels for the defendants, barrister Paweł Sowisło and barrister Urszula Nowaczyk, take the position that the charges raised in the indictment are manifestly unfounded and are not supported by evidence.
