“When can a municipality demand the return of a discount granted when buying out a flat” – article by our lawyers in “Dziennik Gazeta Prawna”

“Dziennik Gazeta Prawna” in its “Samorząd i Administracja” supplement (No. 242/2021) of 15 December 2021 published an article by barrister Aneta Fornalik and attorney-at-law Agata Wencel-Socha entitled: “When can a municipality demand the return of a discount granted when buying out a flat”.

The article addresses a practical issue of many municipalities, i.e., claiming the return of the discount from heirs of the original purchaser of the flat. The moment when the obligation to return the discount turns out to be decisive – each case should be considered individually and thoroughly. The reimbursement of the discount is obligatory if the statutory prerequisites for reimbursement are fulfilled.
