We offer professional legal assistance at every stage of the awarding public procurement procedure, starting of the stage of preparing the offer through the decision stage, up to the stage of contract implementation. Legal assistance in the field of public procurement is provided by the Department of Public Procurement Law, which is composed of specialized legal counsels, legal counsel apprentices and lawyers with years of practical experience in applying the provisions of the Public Procurement Law. Legal counsels of the Department will efficiently guide you through the appeal procedure, as they effectively represent our clients before the National Appeals Chamber, by which they contribute to the issuing of judgments of key importance for other participants of the public procurement market, often breaking the current ruling line. We prepare legal opinions, audits and analyzes. We also offer legal assistance in pursuing claims for damages in connection with the participation in the awarding public procurement procedure (eg retention of the bid bond) or in connection with the performance of the contract.

For CONTRACTORS, the scope of legal assistance provided includes in particular:

  • assistance on the correct preparation of the offer,
  • giving opinions on documentation prepared by the client,
  • preparation of information about activities incompliant with the provisions of the Public Procurement Law (former form of protest),
  • preparing expert reports on the examination and evaluation of customer’s competition offers, in the agreed scope,
  • making appeals to the President of the National Appeals Chamber,
  • ongoing legal advice,
  • trainings devoted to the subject of Public Procurement Law,
  • representation before the National Appeals Chamber and common courts.

For the AWARDING ENTITIES, the scope of legal assistance provided includes in particular:

  • preparing and conducting the entire tender procedure,
  • preparation of the Specification of Essential Terms of the Contract containing, along with other elements required by law, an optimal model of the contract or essential provisions of the contract,
  • help in preparing a description of the subject of the contract, in accordance with the provisions of the Public Procurement Law,
  • help in determining the conditions for participation in the proceedings,
  • help in the proper selection of criteria for the evaluation of offers,
  • giving opinions on the Essential Terms of the Order prepared by the awarding entity, including the draft contract,
  • formal and legal analysis of offers of contractors applying for the award of the contract,
  • preparation of the call to supplement or to submit clarification documents pursuant to art. 26 of the Act on Public Procurement Law,
  • control of tender documentation regarding the correctness of the conducted proceedings,
  • participation in the work of tender committees, eg as an expert,
  • ongoing legal advice,
  • trainings devoted to the subject of Public Procurement Law,
  • representation before the National Appeals Chamber and common courts.
