Win in a dispute with the Fiscal Administration Chamber

The Law Firm, acting on behalf of a former Head of the First Wielkopolska Revenue Office in Poznań, was involved in a court dispute with the Fiscal Administration Chamber in Poznań. 

The former Head of the Revenue Office, represented by attorney Ewelina Jeglikowska, sought an award of the amount of retirement severance pay compensation and the amount of basic salary adjustment, in connection with the reduction of her multiplier of the forecast average salary in the public sector, applied to determine the amount of basic salary from PLN 4,300 to PLN 1,789. In the opinion of the Law Firm, the change in the Plaintiff’s salary conditions, made in violation of Article 42 of the Labour Code, was ineffective and the claim was legitimate.

The Fiscal Administration Chamber claimed that the agreements concluded with the employee implied the correctness of the remuneration paid. 

Following the assessment of the evidence, the District Court in Poznań, and then – after the appeal filed by the Fiscal Administration Chamber – the Regional Court in Poznań, shared the position presented by the Law Firm as expressed in the statement of claim and found the Plaintiff’s claims to be fully justified. The former Head of the Revenue Office was awarded both the amount of the retirement severance pay with statutory interest and the amount claimed as an adjustment of the basic salary for the relevant months.
