A win before the National Appeals Chamber, which confirmed the correctness of the conditions of participation and the criteria for evaluation of the tenders

In the public procurement procedure carried out jointly by the District Roads Authority in Poznań and PKP PLK S.A, entitled: Construction of a railway viaduct/road tunnel in  Swarzędzka Street in Kobylnica in the course of district road No. 2407p Koziegłowy – Swarzędz in exchange for liquidation of cat. A railway and road crossing in km 7.532 of railway line No. 353, under the Operational Program Infrastructure and Environment project 5.1-35 entitled “Improvement of safety at crossings of railway lines with roads – Stage III” in the “Design and Build” system National Appeals Chamber on 10 November 2020 (KIO 2654/20) dismissed the appeal filed by the Economic Operator in its entirety. Budimex S.A. complained about the terms and conditions of participation in the procedure and the criteria for evaluation of the tenders as regards the legitimacy of the evaluation of the personnel assigned to the contract (site manager, designer), as specified by the Employer.

The Contracting Authority was effectively represented in the proceedings before the National Appeals Chamber by: attorney-at-law Grzegorz Józefiak and attorney-at-law Wojciech Piórkowski from the Public Procurement Law Department.
