Restructuring. Insolvency

We offer comprehensive support to entrepreneurs and individuals, both before filing for bankruptcy, including consumer bankruptcy, and during the proceedings following the recognition of such a request. We represent and advise both debtors facing insolvency and those trying to recover their debts from contractors, in both bankruptcy and restructuring proceedings.

Legal assistance in the scope specified above is provided at all stages and in all types of proceedings, in particular:

In bankruptcy proceedings:

• during the assessment of the debtor’s financial and economic situation, by preparing all the necessary documentation for the effective filing of the bankruptcy petition and the petition itself,
• representing the debtor before the court at all stages of the proceedings,
• maintaining constant contact with the court-appointed supervisory authority during the application review stage, and then with the trustee,
• support and representation of the debtor in contact with bankruptcy proceedings authorities and preparation of necessary financial and legal documentation,
• taking actions on behalf of creditors, including:
• preparing the necessary documentation to file a claim,
• filing all necessary applications on behalf of the creditor,
• monitoring the status of bankruptcy proceedings,
• challenging actions and rulings issued during the course of the proceedings (filing objections to the list of claims or objections to the division plan),
• representing creditors within the framework of bankruptcy proceedings: the creditors’ council or the creditors’ meeting.

In the course of restructuring proceedings:

• assessment of the debtor’s financial situation and the possibility of restructuring based on the debtor’s available assets, personnel, and contracts,
• preparing business plans, financial, tax and economic consulting, focusing on the selection of the appropriate type of proceedings,
• taking and maintaining contact with creditors, preparing their list and determining the level of the debtor’s debt, which allows for the selection of the most favorable form of restructuring,
• advising on the creation of settlement proposals that are as attractive as possible for creditors while securing the debtor’s assets and production capacity at a level that allows not only for the implementation of the settlement but also for the debtor’s continued operation in the market,
• representing the debtor in contacts with creditors, obtaining their positive stance towards the proposed settlement,
• conducting the debtor through the entire court proceedings and representing them in contacts with the restructuring advisor, with the final effect of concluding an arrangement with creditors.

We also represent creditors throughout the restructuring process, in all its forms, from reviewing the debtors’ proposed settlements and restructuring plans to contacting debtors and their restructuring advisors and taking formal positions on the settlement.

We participate in all necessary court proceedings, striving to optimally protect our clients’ interests.
